Appropriation and copyright


Today's discussion reminded me of this video.

  1. Yessssss! This is such a crazy thing to me. I used to have a blogspot that talked about new releases/new bands and I spent one post talking about a loop from the end of the Jon Brion-scored film "Eternal Sunshine of the Spotless Mind." I found that same loop as the core melody of a track from a band called Memoryhouse who had written three different songs based around that same loop. I commented on the use of that loop in the song and referred to it as a Jon Brion composition. About a year after I'd let that blog go defunct, a commenter left me a note about how the sample was a melodic permutation not at all created by Jon Brion and replicated all over the place, similar to the drum break above although obviously less ubiquitous.

  2. Here's a link that actually sets up the comparison of the two compositions. The site is obviously calling out Memoryhouse's "sampling" but, again, that's evidently not the correct language for this particular situation.
